This Privacy and Cookies Policy (hereinafter referred to as the "Policy") sets out the rules for the processing of Personal Data of Users of the website at https://www.neuromag.med.pl ,as well as the use of cookies or other similar technologies in connection with the operation of the Website.

Capitalized terms not defined in the Policy have the meaning given to them in the Regulations for the provision of electronic services for online neurological advice, which is available HERE.

PRIVACY POLICY
  1. The administrator of your Personal Data is Zakład Lekniczo-Diagnostyczne Chorób Przemysłu Nerwowego Neuromag spółka z ograniczoną odpowiedzialnością with its registered office in Pszczyna, 27B Ogrodowa St., entered by the District Court Katowice-Wschód in Katowice, VIII Commercial Division of the National Court Register, to the Register of Entrepreneurs of the National Court Register under KRS number 0000665470 , REGON: 366647092, NIP: 6381821351, share capital: PLN 5,000 (hereinafter referred to as "Neuromag"), in the following scope:
    • in order to provide services by electronic means (including for the purpose of providing medical services) - on the basis of the Agreement concluded between the User and Neuromag (Article 6(1)(b) of the GDPR);
    • in order to perform obligations under the law (including tax or accounting regulations) - on the basis of Neuromag's legal obligations set out in the provisions of generally applicable law (Article 6(1)(C) of the GDPR));
    • for the purposes necessary to fulfill the legal obligations incumbent on Neuromag, resulting in particular from the Act of November 6, 2008 on patient rights and the Patient Ombudsman (Journal of Laws of 2020, item 849, as amended) (Art. 6(1)(c) GDPR);
    • in order to ensure the accountability of the processing of Personal Data (including demonstrating that Personal Data is processed in accordance with the principles regarding the processing of Personal Data referred to in Article 5 of the GDPR) - on the basis of Nuromagu's legal obligations set out in the GDPR (Article 6(1) of the GDPR) point c GDPR);
    • for the purposes necessary to establish, pursue claims and defend claims related to the provision of Medical Services, resulting from legitimate interests pursued by the Medical Entity (Article 6(1)(f) of the GDPR);
    • to the extent necessary for the purposes of preventive health or occupational medicine, medical diagnosis, provision of health care, treatment or management of health care systems and services, based on the provisions of generally applicable law, in particular the Act of November 6, 2008 on patients' rights and the Ombudsman for Patients' Rights (Journal of Laws of 2020, item 849, as amended) and the Act of April 15, 2011. on medical activity (Journal of Laws of 2020, item 295, as amended) (Article 9(1)(h) of the GDPR).

  3. Personal Data will be stored by Neuromag for the following periods:
    • processing for the purpose of providing electronic services - Personal Data will be stored for the duration of the services in accordance with the Regulations, but no longer than until the notice, expiry or termination of the Agreement for the provision of electronic services or the limitation of claims, and in the scope of complaints Personal Data will be stored by complaint handling time, but not longer than until the final consideration of the User's complaint;
    • for the purposes necessary to fulfill the legal obligations incumbent on the administrator, resulting in particular from the Act of November 6, 2008 on patient rights and the Ombudsman for Patients' Rights - Personal Data will be processed for a period of time resulting from generally applicable law;
    • processing to ensure the accountability of the processing of Personal Data - Personal Data will be stored for the duration of the services in accordance with the Regulations, but no longer than until the notice, expiry or termination of the Agreement for the provision of electronic services or the limitation of claims;
    • for the purposes necessary to establish, pursue claims and defend claims - Personal Data will be stored for the duration of the Agreement, and then for the period of limitation of claims resulting from the relevant legal provisions.
    • to the extent necessary for the purposes of preventive health care, medical diagnosis, provision of health care, treatment or management of health care systems and services - Personal Data will be stored for the time specified in the provisions of generally applicable law, in particular the Act on Patient Rights, according to which the medical entity has the obligation to keep the Patient's medical records for at least 20 years.
  4. The recipients of your Personal Data for which Neuromag is the administrator will be Persons authorized to provide medical services, as well as external entities providing supporting IT systems, providing services related to the current operations of Neuromag (accounting, taxes) - pursuant to relevant agreements entrusting the processing of Personal Data and while ensuring that the above-mentioned entities use technical and organizational measures to ensure adequate protection of Personal Data.
  5. Personal Data will not be transferred by Neuromag outside the European Economic Area, to third countries or international organizations. Personal data may be transferred outside the European Economic Area, to third countries as part of the use by Neuromag of the services of entities providing solutions and IT systems, which entities may store personal data on servers located outside this area. The basis for such a transfer may be a decision of the European Commission stating an adequate level of protection or the application of appropriate legal safeguards, which are in particular standard contractual clauses for the protection of personal data, approved by the European Commission. If the European Commission does not issue a decision stating an adequate level of protection or does not provide appropriate legal safeguards, Personal Data may be transferred to a third country on the basis of one of the premises listed in art. 49 sec. 1 GDPR. The data subject has the right to obtain a copy of personal data and to obtain information about the place where data transferred to third countries are made available.
  6. Personal Data processed by Neuromag will be subject to profiling. Based on personal data, the Administrator performs profiling, i.e. automatic assessment of certain personal factors concerning the User. Profiling is performed in order to provide neurological advice online by Neuromag for the User, including communication with recipients of services offered by Neuromag. The following data may be subject to profiling: name, surname, age, gender, telephone number, e-mail address
  7. User data is not processed automatically, without human intervention.
  8. If Personal Data is processed on the basis of the consent of the data subject, the provision of personal data is voluntary. Failure to provide data will result in the inability to provide the service, if the consent is a condition for the provision of this service.
  9. If Personal Data is processed for the purposes necessary to perform the contract to which the data subject is a party, or to take action at the request of the data subject before concluding the contract, the provision of personal data is voluntary, but necessary to conclude the contract.
  10. If the processing of Personal Data is necessary to fulfill a legal obligation incumbent on Neuromag, the provision of personal data is a statutory requirement..
  11. If the processing of your Personal Data is based on legitimate interests pursued by Neuromag (Article 6(1)(f) of the GDPR) - you have the right to object to such processing of Personal Data for reasons related to your particular situation under Art. 21 GDPR.
  12. If the processing of your Personal Data consists in profiling and is based on legitimate interests pursued by Neuromag (Article 6(1)(f) of the GDPR) - you have the right to object to such processing of Personal Data for reasons related to your particular situation pursuant to art. 21 GDPR.
  13. If the processing of your Personal Data is based on your consent (Article 6(1)(a) of the GDPR or Art. 9 sec. 2 lit. a) GDPR) - you have the right to withdraw your consent at any time. Withdrawal of such consent does not affect the lawfulness of the processing which was made on the basis of consent before its withdrawal.
  14. In the case of processing your Personal Data, you have the right to request access to your Personal Data, rectification, deletion and the right to limit the processing of Personal Data.
  15. In the scope of Personal Data processed for purposes arising from legitimate interests pursued by the administrator (Article 6(1)(f) of the GDPR), you have the right to object to the processing of personal data by electronic means to the address neuro@neuromag.med.pl.
  16. With regard to the processing of Personal Data for the purposes necessary to perform the contract, you have the right to transfer data, including the right to receive data and send it to another administrator or to request, if technically possible, to send this data directly to another administrator.
